Orders of Protection in New York State

Victims of domestic violence, stalking, or harassment in New York State can pursue two forms of an Order of Protection from the courts to prevent further abuse. Importantly, the parties involved do not need to be married or live together.

  • “Refrain from” order: This type of order prohibits the abuser from threatening, harming, or harassing the victim in any manner.
  • “Stay away” order: In addition to prohibiting the abuser from threatening, harming, or harassing the victim, this order requires the abuser to maintain a specific distance from the victim’s residence or place of employment. If the parties live together, the abuser will be forced to leave the shared home.

Orders of Protection carry serious consequences. Penalties for failing to comply may include fines, imprisonment, and additional criminal charges.

Filing an Order of Protection in New York

Petitioning the court for an Order of Protection against a potentially dangerous person—referred to as the Respondent in legal terms—requires certain conditions to be met. An Order of Protection may be issued if one of the following types of prior relationships is established:

  • You are related to the Respondent by marriage or blood.
  • You are currently married to or were previously married to the Respondent.
  • You are or were involved in an intimate relationship with the Respondent. Note that a casual acquaintance or someone from a typical social context does not qualify as an intimate relationship.
  • You share a child with the Respondent.

An Order of Protection directs the Respondent not to assault, threaten, or harass you. When requesting an order, you can ask the court to include additional conditions. For example, you may request that the order cover your home and workplace and that the Respondent be barred from contacting you by phone, whether at home or work. If child custody is involved, you can ask for the order to be extended to your children. Additionally, you may request a police escort to safely return to a shared residence to collect your belongings.
