Divorce Do's and Dont's

Find out what you should and shouldn't do during the divorce process.

High net worth divorces tend to have a heightened potential for mistakes on both sides.  Clients will often agree to anything just to get out of the marriage.  However, agreeing to terms such as maintenance, or division of assets and liabilities just to get away from a person can have devastating effects on you financially.  It is important to conduct a thorough analysis before finalizing your divorce.

Some spouses will attempt to hide assets by transferring them to a third party such as a business partner or child from a former marriage.  Transfers like these will end up being set aside as fraudulent.  Tax considerations are also a critical component of a high net worth divorce.

Revenge is not an appropriate motivation for making sound decisions in an already difficult and emotionally stressful time.  While it may feel good initially, in the end, the money you are making the other person spend is your money too.

A good lawyer will fight hard for you, but will not provoke or extend a fight that isn’t in your best interests.  Lawyers are your advocates and are hired to represent you zealously to the best of their ability – not to start fights so that they can enrich themselves at your expense.  A simple consultation can answer important questions, and is well worth the time compared to what one could lose from making a mistake either through lack of knowledge of the law or through emotional reaction in a time of stress.

Are you thinking about entering into a Prenuptial Agreement? Are you considering filing for divorce or separation?  When a couple decides to dissolve their marriage, there are many aspects that need to be addressed including child custody and financial support, parenting time/visitation, spousal support and equitable distribution, to name a few.  These are subjects that Jay D. Raxenberg, P.C. has gained a great deal of experience in over the last two decades in Supreme and Family Court in the tri-state area.  Mr. Raxenberg has extensive training, knowledge and experience in this area of the law and is dedicated to providing exceptional compassionate legal representation to all of his clients.  Please call (516) 491-0565 or toll free at (888) 543-4867 to arrange your initial complimentary consultation.
