The Second Department recently ruled on pressing custody and visitation issues. Whether your concerns about parenting access time, custody, or visitation are entangled in your divorce or are separate from a matrimonial action, parties litigating these issues are likely to be concerned and anxious about the best interests of their children. Fortunately, the Appellate Division agrees.

In April 2015, the court ruled in Cannella v. Anthony, A.D. 3d- N.Y.S 3d (Second Dept. 2015) (Apr. 01, 2015) that an existing custody arrangement may be modified upon showing a change in circumstances warranting such modification in the child’s best interest given the totality of the circumstances. This opinion was also reflected in the Second Department’s holding in Thomas v. Wong, A.D. 3d N.Y.S 3d (Second Dept. 2015) (Apr. 01, 2015).
