The Second Department recently ruled on pressing custody and visitation issues. In April 2015, the court ruled in Cannella v. Anthony, A.D. 3d- N.Y.S 3d (Second Dept. 2015) (Apr. 01, 2015) that an existing custody arrangement may be modified upon showing a change in circumstances warranting such modification in the child’s best interest given the totality of the circumstances. This opinion was also reflected in the Second Department’s holding in Thomas v. Wong, A.D. 3d N.Y.S 3d (Second Dept. 2015) (Apr. 01, 2015).
