While most Americans are still celebrating last week’s landmark Supreme Court decision which legalized gay marriage in all 50 states, others are already beginning to question what this means for potential same- sex divorce.

The Huffington Post recently featured a piece that detailed the journey of two women that were legally married in Massachusetts in 2009 and have since relocated to Louisiana. While Massachusetts has recognized gay marriage since 2004 and does not require a residency permit to marry within state borders, the couples new home in Louisiana did not recognize their union, or the couple’s legal right to file for a divorce… at least until last Friday.

Just hours before the first same sex couple married in Louisiana, Anna Wellman and Stephanie Baus were able to legally obtain the divorce they had been seeking since separating some years ago. While the Supreme Court’s decision is certainly a triumph for equality, it also provides gay couples with the ability to legally, financially, and emotionally separate from a partner when they previously were unable to do so in most jurisdictions.

Despite the fact that the complexities of divorce have been fairly mainstreamed, experts note that it may take some time to work out all of the difficulties of same sex marriage.
